Contest Terms and Conditions

 

ELIGIBILITY AND PARTICIPATION

1. This contest is sponsored by FabulousPetSupplies.com and BJS Emporium.

2. This contest is open to anyone currently residing in the United States or Canada, except employees of FabulousPetSupplies.com and BJS Emporium.  

3. Contestants are responsible for compliance with applicable laws in jurisdictions in the State or Province where they reside.

4. No purchase is necessary to enter the contest.

5. By entering this contest, entrants automatically agree to be bound by the terms of this contest as listed here.

6. This contest is null and void in any jurisdiction where prohibited by law.

7. Failure to adhere to the terms and conditions listed in this Contest Terms and Conditions will result in disqualification of any submitted entries, and the nullification of contestant privileges to further participate in the contest.

 

SUBMISSIONS OF ENTRIES AND DEADLINES

1. The Contest will be opened for entry submissions starting February 01, 2012. All entries must submitted no later than 12pm PST, Tuesday, June 01, 2012. Late entries will be rejected.

2. To be eligible to participate, entrants must be at least the age of majority (legal age) of the State or Province in which you reside.

3. Entrants must submit pictures of their dog or dogs in jpeg or gif format to be eligible. Submissions should be received through email to: contest@FabulousPetSupplies.com.

4. Entrants must provide the following information:

Only the dogs name and City will be displayed on the website alongside their picture.The privacy of all contestants will be respected. The contestant information will be used for the benefit of this contest only and names, addresses, email addresses or any contact information will not be released or sold in any manner to any third party. Incomplete entry forms will be deemed disqualified and will be rejected. FabulousPetSupplies.com is not responsible for any lost, misdirected or delayed entries. There is also no responsibility or liability on the part of FabulousPetSupplies.com or BJS Emporium for any potential entrant's inability to submit their entry following the contest guidelines.

5. Entries received by telephone, fax, courier, or any other method other than email will not be accepted.

6. Each submission must be the property of the entrant, the pictures must be taken by a nonprofessional, and the dog must be owned by the entrant. Each contestant may submit a maximum of 3 photographs. Only one prize will be awarded.

7. By submitting any entry, entrants agree to be bound by the terms and conditions set forth in this document without limitation. Entries must not include content that is unlawful, harmful, vulgar, obscene, hateful, harmful to animals, or racially, ethnically or otherwise objectionable, the determination of which is up to the sole discretion of FabulousPetSupplies.com.

 

WINNER SELECTION AND NOTIFICATION

1. All eligible contest entries will be displayed on our website for visitors to vote between June 01, 2012 and June30, 2012. Each visitor will be allowed to vote for as many photographs as they want, with the limitation of one vote per photograph. Public voting will have this time frame plus a period of two (2) weeks after the deadline to vote. After that, entries will be reviewed and counted by the staff of FabulousPetSupplies.com. The entry receiving the highest amount of votes will be declared the winner.

2. In the event of a tie the winner will be determined by submitting each tied entrant into a draw. The winner of the draw shall be deemed the winner of the contest. There will be only one winner for this contest.

3. The odds of winning are dependent on the number of participants and cannot be determined in advance. 

4. The winner shall be notified by email by July 15, 2012. The announcement of the winners will also be posted on the FabulousPetSupplies.com website. The winner will be notified via e-mail. If the winner does not respond to the notification within five (5) business days, another winner will be chosen. Failure to respond within five (5) business days shall mean that the winner has forfeited the prize.

 

PRIZES

1. There is one winner of this Contest and the winner will receive a $100 gift certificate which can be put towards the purchase any number of products from the FabulousPetSupplies.com website. 

2. No prize substitution or changes are allowed. The entire prize certificate must be redeemed for product(s) on the FabulousPetSupplies.com website. The winner will have 60 days from the date notified to redeem the gift certificate. The winner must redeem the certificate with a one time purchase that equals or exceeds $100. Shipping is included up to a maximum prize redemption of $100. For example: The winner chooses purchases totaling $95 and the shipping costs equal $10 resulting in the total purchase price being $105. FabulousPetSupplies.com will cover $100 and the winner will be responsible for $5 of the shipping costs. Any portion of the winning gift certificate not redeemed will be considered forfeited by the winner.    

3. Odds of winning a prize will vary depending upon the number of actual Contest participants. In the event any entry is deemed ineligible or disqualified, FabulousPetSupplies.com may award the prize to an alternate entry as it deems suitable.  

4. In accepting the prizes, the contest winners acknowledge that FabulousPetSupplies.com may not be held liable for any loss, damages or injury associated with accepting or using the prize.

 

CONTEST SUBMISSION AGREEMENT

1. All entries must be the original photographs of the entrants. All pictures professionally taken will be disqualified. The entrants must own the dogs in the submitted entry. Contestants must be legal age in the State or Province in which they reside.

2. By submitting photos to FabulousPetSupplies.com, you represent and warrant that the photos do not infringe any copyright, trademark, property rights, rights of privacy or publicity of any person, or any other right of any third party and that you have the full and unrestricted right to transfer the photos to FabulousPetSupplies.com free and clear of any claims or encumbrances.

3. All photos submitted by you to FabulousPetSupplies.com shall become the sole and exclusive property of FabulousPetSupplies.com, and FabulousPetSupplies.com or BJS Emporium shall have no obligation to preserve, return, or otherwise make available to you or others any Materials. FabulousPetSupplies.com may use, reproduce, edit, display, transmit, modify, publish, and otherwise make use of Materials in any and all media, whether now known or hereinafter created—throughout the world and for any purpose—without compensation to you of any kind. By submitting photos to this contest, all contestants grant FabulousPetSupplies.com and BJS Emporium a non-exclusive, worldwide, royalty-free right to use the submitted entry for commercial, business, and trade purposes, as well as for advertising and/or publicity purposes. Additionally, contestants hereby agree and acknowledge that FabulousPetSupplies.com may, in its sole discretion, modify the size of the submitted image to accommodate the website design.  

4. Contestants may NOT submit offensive, pornographic, obscene, criminal or adult themes, links or images or images reveling or relating to animal abuse. FabulousPetSupplies.com reserves the right to decide what constitutes deletion, suspension, or banning within the contest.

 

GENERAL

1. All entrants, as a condition of entry into the contest, agree to release FabulousPetSupplies.com and BJS Emporium staff from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property associated or sustained in connection with participation in any and all aspects of the contest, including accessing the contest, submitting an entry, the receipt, ownership or use of any prize. Each prize winner bears all risk of loss or damage to his or her applicable prize after it has been delivered.

2. All prize winners will be responsible for any and all federal, state, provincial, and/or local taxes resulting from acceptance of any and all prizes associated with this Contest. Prize winner cannot assign or transfer the prize to another person.

3. Neither FabulousPetSupplies.com, BJS Emporium, its staff, nor its Contest sponsors assume any responsibility or liability for (i) any incorrect or inaccurate entry form information, or for any faulty or failed electronic data transmissions; (ii) any authorized access to, or theft, destruction or alteration of entry forms or submissions at any point in the operation of this Contest; (iii) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the submission of an entry or the operation of the Contest; (iv) inaccessibility or unavailability of the Internet; or (v) any injury or loss of participants which may be related to or resulting from any attempt to participate in the Contest or download of any materials in the Contest.

4. You agree that you will submit any dispute you may have with regard the conduct of the Contest, interpretation of the Rules, and/or awarding of prizes to FabulousPetSupplies.com, whose decision regarding such dispute shall be binding and final. All disputes must be submitted in writing, and sent to us at: contest@FabulousPetSupplies.com.

5. All decisions are final.

6. The prize winner will be announced on the FabulousPetSupplies.com website on March15, 2011. Prize winner will be also be contacted by FabulousPetSupplies.com via email for the claiming of their prizes.

7. Participants must be legal age in the State or Province in which they reside. Proof of age may be requested prior to the prize being awarded.

8. FabulousPetSupplies.com reserves the right to abbreviate, modify, suspend, cancel, or terminate this Contest at any time without prior notice, and without further obligation or liability to you. FabulousPetSupplies.com also reserves the right to change this Terms and conditions at any time without prior notice.
